Mutual Recognition deregistration

The Victorian Building Authority (VBA) has deregistered 25 builders in Victoria over the past month. The 25 were registered in Queensland originally and then in Victoria under the Mutual Recognition Act. These builders have now been deregistered in both states.

"Victoria's consumers must be able to have confidence that the system is working to ensure only legitimately qualified practitioners are registered," said Prue Digby, Chief Executive Officer of the VBA. 

"The VBA will act to ensure consumers can have confidence in the building industry and are properly protected," said Ms Digby.

The Commonwealth Mutual Recognition Act allows for building practitioners registered in one state or territory to be automatically registered in another.

Through improved monitoring of VBA registration data and trends, an unusual increase in the number of mutual recognition applications was observed and scrutinised giving rise to concerns of possible inappropriate activity.

In addition, Victoria has refused a number of mutual recognition applications from Queensland and has increased its scrutiny of mutual recognition applications in Victoria.

The VBA continues to work closely with the Queensland Building and Construction Commission (QBCC) and other interstate regulators and is in discussion with Victoria Police over the matter.

Ms Digby said 14 domestic building permits had been issued to the deregistered builders and the VBA has now visited all 14 sites and no issues requiring intervention have been identified.

The VBA is working with other agencies and industry bodies to support the customers of these deregistered building practitioners. Consumers can check whether their builder is registered by visiting the 'Find a Practitioner' section of the VBA website. If your builder is not registered, and is still working on your site, contact your building surveyor and the VBA immediately.

DB-L – Domestic Builder Restricted to BCA 1a, 4 &10 - Unlimited BCA 2, FA =2000m2 - Type C only

  • BCA 1a, 4 &10 – Unlimited: This allows practitioners to build single, detached dwellings or one or more attached dwellings such as townhouses with no restrictions. This also includes non-habitable buildings such as garages and sheds.
  • BCA 2, FA =2000m2 - Type C only: This allows practitioners to build 2 or more sole occupancy units with a max floor area of 2000m2 and max height of 1 storey.

CB-L – Commercial Builder - Limited (Class: Low rise) Restricted to BCA 1b & 10 - unlimited BCA 3, 5-9, FA =2000m2 - Type C only

  • (Class: Low rise) Restricted to BCA 1b & 10 – Unlimited: This allows practitioner to build boarding house, guest house, hostel, backpackers accommodation, motel etc. as well as non-habitable structures such as garages and sheds.
  • BCA 3, 5-9, FA =2000m2 - Type C only: This allows practitioners to build non-residential structures such as office buildings, shops, carparks, laboratories, schools, aged care facilities etc. with a max floor area of 2000m2 and max height of 2 storeys
