VBA Actions for the week ending 10 May 2019

A summary of VBA prosecutions, show cause notices, notices of decision, permit levy audits, proactive inspections and plumbing activities for the week.

Prosecutions

Four matters were prosecuted in the Magistrates’ Court.

Dandenong Magistrates’ Court

  • A guilty plea was entered. The Court imposed a fine, with costs of approximately $1900 awarded to the VBA.
  • A guilty plea was entered. The Court imposed a 12-month good behaviour bond, with costs of approximately $1900 awarded to the VBA.
  • One matter was adjourned.

Geelong Magistrates’ Court

  • One matter was adjourned.

Show Cause Notices

  • One Show Cause Notice was issued for alleged breaches of the Building Act and Building Regulations, including failing to carry out work in a competent manner and to a professional standard, and failing to pay a fee due to be paid under the Act.

Notices of Decision

  • A building surveyor was reprimanded and fined $23,000 for breaches of the Building Act and Building Regulations.

VCAT decisions

  • One matter was finalised at VCAT.

Permit levy audits

  • Four levy audits were completed.

Proactive inspections

  • 285 inspections completed in 23 municipalities.
  • Three building orders for minor works were issued.
  • 98 inspections completed in Ballarat as part of the Build Aware inspections and education campaign.
