VBA Actions for the week ending 26 September 2019
Investigations
- One warning letter issued.
Prosecutions
- Six matters were heard in the Magistrates’ Court – two plumbing and four building.
- Guilty pleas were entered in both plumbing matters, resulting in fines being imposed.
- Of the building matters, two were adjourned, awaiting the outcome of a related matter before the Building Appeals Board.
- A third building matter was finalised by plea, with the Court imposing on the accused an adjourned undertaking requiring them to be of good behaviour for 12 months.
- A fourth building matter was finalised by way of a fine.
Victorian Civil and Administrative Tribunal matters
- Cerantonio v VBA – Matter resolved during a compulsory conference.
- Ottery v VBA – Matter resolved during a compulsory conference on 30 July. Additional tasks have now been completed, closing this matter.
Building Appeals Board matters
- Spottiswood v VBA – The BAB affirmed a prior VBA decision to not terminate the appointment of a relevant building surveyor.

- 132 inspections across 18 municipalities.

Statewide Cladding Audit
- Eight inspections were completed, six within the City of Melbourne and two in other municipalities.
- Six expert panels were conducted. From these, one building was rated extreme risk, one was rated high, three were rated moderate and one was rated low.
- 15 inspections are scheduled for the week commencing Monday, 30 September 2019.
