Complaints and Statutory Referrals

  • Two warning letters were issued for failing to comply with a building order.
  • Two other warning letters were issued to building practitioners for failing to call for a mandatory inspection.
  • One warning letter was issued for constructing a fence without a building permit in force.
  • One warning letter was issued for approving plans that breached overlooking requirements.
  • One warning letter was issued to a site owner who failed to:
    • supply their neighbour with a copy of a renewed protection work insurance certificate
    • conduct a protection work survey of adjoining property
    • sign that survey
    • lodge plans showing the protection work carried out with their neighbour and building surveyor.

  • APM Group (Aust) Pty Ltd v Victorian Building Authority (VCAT 1156) – finalised by decision.
  • Jordan Mifsud v Victorian Building Authority (VCAT Z32/2020) – withdrawn on 16 October 2020.
