VBA recommends building practitioners inform owners of their statutory obligations

Almost one in three complaints about protection work received by the Victorian Building Authority since mid-2018 relate to the responsibilities of building owners.

To prevent unnecessary complaints, possible delays and disputes between an owner and an adjoining owner, building practitioners should inform property owners of their statutory obligations under sections 93 and 94 of the Building Act 1993.

The role and responsibilities of property owners under the Act in relation to protection work include:

  • arranging insurance cover for the protection work before it commences (section 93)
  • arranging for a survey of the adjoining property before any protection work commences (section 94).
