Reminder that building permit documents are to be provided by the applicant

The VBA would like to remind the building industry that it is the responsibility of the building permit applicant to provide the necessary information to demonstrate that building work will comply with the Building Act 1993 (Act) and Building Regulations 2018 (Regulations).

An application for building permit must be accompanied by sufficient information, however the relevant building surveyor (RBS) may require additional information to be submitted under Regulation 29, including documentary evidence under Part A5 of the National Construction Code (NCC).

It is the responsibility of everyone in the supply chain to ensure that products that comply with the Performance Requirements of the NCC are selected.

The VBA is aware that some product manufacturers will only provide documentation and information relating to their products, such as copies of test reports, where the RBS makes a formal written request for each required report. Building surveyors should not be chasing information from manufacturers and may refuse to issue a building permit where there is insufficient information to demonstrate compliance with the Act and Regulations.

Product manufacturers should be transparent about product performance by providing documentation to support the proposed use of products when requested by a building permit applicant.

If a request is unreasonable, the owner may appeal to the Building Appeals Board under section 138(1) of the Act against the refusal or deemed refusal of the permit.
