Building surveyor documentation and information obligations to councils

Building surveyors are reminded they are required to provide certain documents and information to councils related to building permits, occupancy permits and certificates of final inspection.

These requirements fall under various sections of the Building Act 1993 and Building Regulations 2018:

  • Section 30 requires building surveyors to give copies of building permits and documents to council within seven days of issuance, including those prescribed in regulation 44.
  • Section 30B requires the relevant building surveyor to provide the certified checklist approved under section 30A when providing the section 30 documents.
  • Section 73 requires building surveyors to give copies of occupancy permit, temporary approvals, amendments to any permits and approvals under Part 6 of the Act, along with any plans and documents lodged with the application to council within seven days of issuance, including documents prescribed under regulation 203.
  • Regulation 205 requires the building surveyor to give copies of the certificate of final inspection to the council within seven days of issuance and after issuing an occupancy permit or a certificate of final inspection. They must also give council the approved dates of the inspection carried out for the mandatory notification stages of the building work carried out on the building or land.

Councils are also reminded of their obligations to keep certain records:

  • Section 31 – keep a register of all building permits given to it under Division 5 Part 3 of the Act and make the register available for inspection by any person during normal office hours.
  • Section 32 - keep all documents given to them for the prescribed period, in the prescribed manner (refer to regulation 49).
  • Section 74 - keep a register of all occupancy permits and temporary approvals and amendments given to it under division 4 of Part 5 the Act and make the register available for inspection by any person during normal office hours.
  • Section 75 - keep all documents given to them for the prescribed period and in the prescribed manner (refer to regulation 202).
